Press Pass, Inc. ("Press Pass") maintains this site (the “Site") for your personal entertainment, information, and communication, and you are invited to browse the Site in its entirety.

Your access to and use of the Site is subject to the following terms and conditions (the “Terms and Conditions") and all applicable laws. By accessing the Site, you accept, without limitation or qualification, the Terms and Conditions set forth below.

The use of any material on the Site by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms and Conditions or specific permission is provided elsewhere on the Site, or is specifically granted by Press Pass. Accuracy: Press Pass uses reasonable efforts to insure information on the Site is accurate and up to date; however, no warranties or representations are made or implied by Press Pass as to the accuracy of such information. Press Pass assumes no liability or responsibility for any errors or omissions in the content of the Site. Furthermore, Press Pass reserves the right to change products, pricing and any other information at any time without prior notice or obligation.

Rights Granted: Any communication or material you transmit to the Site by any method, including any data, questions, comments, suggestions, or the like is, and will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by Press Pass for any purpose. Furthermore, Press Pass is free to use any ideas, concepts, or techniques contained in any communication you send to the Site for any purpose whatsoever, including, but not limited to, developing, manufacturing and marketing products using such information.

 

Press Pass Trademarks: The trademarks, logos, and service marks (collectively, the “Trademarks") displayed on the Site are registered and unregistered Trademarks of Press Pass, or third party trademark holders. Nothing contained on the Site should be construed as granting any license or right to use any Trademark displayed on the Site without the written permission of Press Pass or such third party that may own the Trademarks. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited. You are also advised that Press Pass will aggressively enforce its intellectual property rights to the fullest extent of the law.

 

Links: Press Pass is not obligated to review any third party web sites linked to the Site and is not responsible for the content of any off-site pages or any other sites linked to the Site. Your linking to any other off-site pages or other sites is at your own risk.

 

Postings: Press Pass may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and the like on the Site.  However, Press Pass is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the Site. You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. Press Pass will fully cooperate with any law enforcement authorities or court order requesting or directing Press Pass to disclose the identity of anyone posting any such information or materials.

 

General Provisions: The Site is maintained for the benefit of Press Pass and to exploit its products which are predominantly available in the United States and its territories and possessions. The Site is controlled and operated by Press Pass from its offices in Charlotte, North Carolina, United States of America. Press Pass makes no representation that materials on the Site are appropriate or available for use in other locations. Those who choose to access the Site from other locations do so at their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Press Pass may revise these Terms and Conditions at any time without notice.  Immediately upon the update to this page, you are bound by any such revisions and should therefore periodically visit this page to review the then current Terms and Conditions to which you are bound.

These Terms and Conditions constitute a binding agreement between you and Press Pass, and shall be governed by, construed and enforced in accordance with the laws of the State of North Carolina, as such laws are applied to agreements entered into and to be performed entirely within such State. Any action you, any third party or Press Pass brings to enforce these Terms and Conditions or, in connection with, any matters related to the Site shall be brought only in the state or Federal Courts located in Mecklenburg County, North Carolina, and you expressly consent to the jurisdiction of said courts. If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein, which shall not be modified except in a writing signed by Press Pass.

All unsolicited submissions (whether by email, on paper, by fax, posting on a list server or any other means) of storylines, characters, cards, names, illustration, design mechanics or other material (hereafter referred to as the “Work") shall become the property of Press Pass, Inc., a North Carolina corporation (hereafter referred to as “Press Pass"), immediately upon said submission of the Work to Press Pass. By making the unsolicited submission, the submitter thereby assigns to Press Pass without reservation all of the submitter’s right, title and interest, including copyright and trademark, in and to the Work (and the intellectual property included in the Work). Press Pass shall thereafter have the right to use or otherwise exploit the Work in any manner Press Pass chooses, which includes the right to publish the Work, reproduce the Work, alter the Work and license the Work to others, without having to account, or provide compensation or other remuneration, to the submitter. This agreement may not be modified, except by a writing signed by Press Pass and the submitter concerning the Work. Press Pass shall not have any duty to publish the name of the submitter as the author of the Work.
